2008 Pride Parade Terms and Conditions

 
 

Thoroughly read and understand all of the following. By filling out this application, you are agreeing to abide by the terms and conditions listed below.

On behalf of and with authority of the organization/business/individual making this application, I hereby declare that:

  1. The applicant agrees to operate in a manner consistent with the celebration of pride and positive value of diversity in the lesbian, gay, bisexual, transsexual, transgender, intersex, queer, questioning and 2 spirited communities. On behalf of and with the authority of your organization/business or individual making this application you hereby declare that policies upholding equal opportunity and non-discrimination have been adopted by which discrimination on the grounds of Race, Colour, Creed, National Origin, Religious or Political affiliation, Sex, Age, Personal or Family Relationships, Disabilities, HIV/AIDS, Income Restrictions, Union Affiliation, Sexual Orientation, and Gender Orientation is prohibited by and within the organization/business or individual. The applicant will not present images or messages that promote or condone, or may promote or may condone, violence, hatred, degradation or negative stereotypes of any person(s) or group(s). Further the applicant will respect the right of all members and supporters of the lesbian, gay, bisexual, transsexual, transgender, intersex, queer, questioning and 2 spirited communities to participate in Pride Week 2008.
     
  2. Your Pride Parade entry may be cancelled with written notification sent to Pride Toronto by June 1st, 2008. Pride Parade fees are NON-REFUNDABLE after June 1st, 2008.

  3. The applicant is fully responsible for any damages to persons or property, as well as any claims, causes, payments or compensation, or settlements arising therefrom, resulting from any activity, omission, violations or any other kind of illegal or wrongful act or activity. The applicant specifically agrees that Pride Toronto assumes no responsibility for damages to persons or property however caused, as a result of or pertaining to the participation and/or activities of any applicant. The applicant agrees that the terms in paragraph 17, below, apply without qualification to all losses and injuries anticipated and generally described by this paragraph.
     
  4. Pride Toronto retains the right to refuse any application, and remove entries from the parade, without liability.
     
  5. The applicant understands that the driver of any vehicle participating in the Parade must possess a valid Ontario Driver's license in the class appropriate to the vehicle, and appropriate insurance available for presentation at all times on the day of the Parade. The applicant understands that any driver who is unable to produce a valid license or insurance will be removed from the Parade.
  6. The applicant understands that alcoholic beverages and controlled substances are not permitted onsite or on the Parade route or staging area. Any drivers found to be intoxicated or with controlled substances or alcohol on their persons or in their vehicles will be removed from the Parade immediately.
  7. The applicant acknowledges that all vehicles require first aid kits, available for presentation at all times on the day of the Parade.
  8. The applicant agrees that all drivers of motorcycles, or any other vehicle that requires such protective gear, must wear the appropriate riding gear, including helmets, while riding their vehicles.
  9. The applicant is fully responsible for and agrees to comply by and enforce all applicable laws and regulations in connection with the event.
  10. The applicant agrees that all signage regarding their partnering financial supporter must be secondary to that of the community organization.
  11. The applicant agrees to build their float and or vehicle to the specifications listed in the Opportunity Guide.
  12. Pride Toronto retains the right to cancel Pride Week or Pride Week events at any time, in part or in full, without liability.
     
  13. Each float must have at least 4 walking monitors to insure the safety of participants and spectators. The applicant agrees to provide the required number of monitors for their entry.
     
  14. All monitors and Pride Parade entrants must attend a training session. Applicant and all relevant monitors agree to attend the mandatory training session. Date & time of the training will be confirmed once your application has been accepted.
     
  15. The Pride Parade and Pride Week is a rain or shine event. Pride Toronto does not assume any liability for bad or inclement weather or other factors outside of the control of Pride Toronto.
     
  16. If there is a fee associated with your participation, applicant agrees that the application will not be processed until payment is received.
     
  17. In consideration of the acceptance of this application and permission to participate as a Pride Parade entrant in the Pride Toronto 2008 Pride Parade, I, for myself, my heirs, executors, administrators, successors and assigns, hereby release, waive and forever discharge Pride Toronto, the City of Toronto, The Toronto Police, the Chief of Police, the Toronto Transit Commission, The Toronto Parking Authority, and all other associations, sanctioning bodies and sponsoring companies, and all their respective agents, officials, servants, contractors, representatives, employees, volunteers, elected and appointed officials, successors and assigns OF AND FROM ALL claims, demands, damages, costs, expenses, actions and causes of action, whether in law or equity, in respect of death, injury, loss or damage to my person or property HOWSOEVER CAUSED, arising or to arise by reason of my participation in the said event, whether as an exhibitor, spectator, participant, competitor or otherwise, whether prior to, during or subsequent to the event, AND NOTWITHSTANDING that the same may have been contributed to, or occasioned by the negligence of any of the aforesaid.

    I FURTHER HEREBY UNDERTAKE to HOLD AND SAVE HARMLESS and AGREE TO INDEMNIFY all of the aforesaid from and against any and all liability incurred by any or all of them as a result of, or in any way connected with my participation in the said event. BY SUBMITTING THIS ENTRY, I ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED TO THE ABOVE WAIVER, RELEASE AND INDEMNITY. I WARRANT that I am physically fit to participate in this event.

    I have READ, UNDERSTOOD and AGREE TO all the terms and conditions of this application. I have READ, UNDERSTOOD and AGREE to all the terms and conditions of the PRIDE WEEK 2008 Opportunity Guide as it pertains to the Pride Parade. I ACKNOWLEDGE that the application will be reviewed and that it will not be considered approved until I receive confirmation from Pride Toronto.
